Interpretation & Definitions

Australian Consumer Law & Your Rights

Our Services come with guarantees under the Australian Consumer Law (ACL), being Schedule 2 to the Competition and Consumer Act 2010 (Cth).

You are entitled to:

• A remedy for minor failures – We will re-perform or rectify any non-compliant Service within a reasonable time.
• A refund or replacement for major failures – A major failure occurs if the Service is unfit for purpose, deviates significantly from description, or creates an unsafe situation.
• Compensation for foreseeable loss – If we fail to provide Services with due care and skill, you may claim reasonable consequential damages.

Nothing in these Terms excludes, restricts, or modifies the application of the ACL.

Services & Scope

We provide self-publishing assistance including:

• Manuscript formatting for Amazon KDP
• Cover design services
• KDP account setup and book upload assistance
• Metadata optimization (title, subtitle, keywords, categories)
• Marketing consultation and advertising setup (where selected)

We do not provide:

• Legal advice
• Copyright registration (though we guide you on the process)
• ISBN purchase (we help you obtain a free ISBN via KDP or guide you to Thorpe-Bowker)
• Guaranteed bestseller status or specific sales rankings

All Services are described in your individual Service Agreement or Invoice, which forms part of this Agreement.

Client Obligations

You warrant that:

• You are the legal owner of all Client Content or have obtained all necessary licenses and permissions.
• Your manuscript does not infringe any third-party copyright, trademark, moral rights, or other intellectual property.
• Your content complies with Amazon KDP Content Guidelines (no plagiarism, no public domain content sold without transformation, no illegal or offensive material).
• You are over 18 years of age or have parental/guardian consent.

You agree to:

• Provide complete and accurate manuscripts in the format we request (typically .docx or .pdf).
• Respond to our queries and approval requests within 7 business days; failure to respond may delay your project.
• Review all proofs (formatted files, cover designs) within 48 hours of delivery.

Intellectual Property Rights

You retain 100% ownership of your manuscript, cover design (final approved version), and all associated intellectual property. We claim no rights over your book.

We retain ownership of:

• Our proprietary formatting templates and workflows
• Any preliminary design concepts not approved by you
• Our training materials, checklists, and internal tools

Upon full payment, we grant you a perpetual, worldwide, royalty-free license to use the final formatted files and cover design for publication on Amazon and other platforms.

You grant us a limited license to display excerpts of your book (cover image, title, author name) on our website, social media, and portfolio for marketing purposes unless you explicitly opt out in writing.

Payment Terms & GST

All prices quoted are in Australian Dollars (AUD) and exclude GST unless stated otherwise.

Under A New Tax System (Goods and Services Tax) Act 1999, we add 10% GST to all taxable supplies. Our ABN will appear on your invoice.

Payment is required as follows:

• 50% deposit to commence work
• 50% balance prior to final KDP upload (or as specified in your Service Agreement)

We accept:

• Bank transfer (preferred)
• Credit card (Visa, Mastercard)
• PayPal

Late payment:

• Invoices unpaid after 14 days from due date may incur a late fee of $50 AUD
• We reserve the right to pause all work until payment is received

Refund & Cancellation Policy (ACL Compliant)

Change of mind is not grounds for a refund under ACL. However, we may offer a credit toward future services at our discretion.

Delivery Timeline & 7-Day Guarantee

Our standard 7-day turnaround begins when:

• We have received your complete manuscript in the required format
• We have received your deposit payment
• You have provided all necessary cover images and author information

The 7-day timeline excludes:

• Weekends and Australian public holidays
• Time waiting for your feedback or approvals
• Additional revision rounds beyond the included amount

If we fail to deliver within the promised timeframe without a valid reason, you are entitled to a 10% discount on the total fee or a partial refund as agreed.

Limitation of Liability

To the maximum extent permitted by Australian law:

• Our total liability to you for any claim arising from these Terms or our Services is limited to the total fees paid by you to us in the 6 months preceding the claim.

We are not liable for:

• Loss of profits, sales, or revenue
• Loss of data or manuscript files (you are responsible for backups)
• Amazon account suspension or termination
• Poor book sales or failure to become a bestseller

Nothing in this clause limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded by law (including ACL guarantees)

Amazon KDP Specific Terms

We are not Amazon, Inc. Final approval of your book rests with Amazon. You acknowledge that:

• Amazon may reject your book for reasons outside our control.
• Amazon may change its KDP policies at any time.
• You are solely responsible for your KDP account.
• If rejection is due to our negligent formatting, we will correct it at no charge.

Privacy & Data Handling

We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

• We collect your name, email, phone number, address, manuscript, cover images, and payment info.
• Data is used only to provide services, communicate about your project, and send marketing emails (optional).
• We do not sell or rent your personal information.

Dispute Resolution & Governing Law

If a dispute arises, contact us first to resolve it informally within 10 business days. If unresolved, either party may refer the matter to the Australian Small Business and Family Enterprise Ombudsman or relevant State agency. These Terms are governed by the laws of New South Wales, Australia.

Indemnity

You agree to indemnify Self Publishing Australia and its staff from any claims arising from:

• Your breach of these Terms
• Violation of third-party rights
• Violation of Amazon KDP policies
• Defamatory, obscene, or illegal content

Force Majeure

We are not liable for delays caused by events beyond our control, including natural disasters, pandemics, internet outages, war, terrorism, or civil unrest. We will resume work as soon as practicable.

Amendments to These Terms

We may update these Terms. Changes are effective upon posting. Material changes for ongoing projects will be communicated 14 days in advance, and you may terminate the Agreement if you do not accept the changes.

Severability

If any provision is unenforceable or invalid, it will be severed, and the remaining provisions remain in effect.

Entire Agreement

These Terms, together with your Service Agreement and Invoice, constitute the entire Agreement between you and Self Publishing Australia.
